PROPOSITION 8
The citizens California have voted in Proposition 8, keeping marriage in the context it has been in since God instituted marriage at the beginning. However, we have the 'no' on Prop 8 making a fuss in every corner of California.
Keeping this in mind, we now must put up with more investment of time, money and the talent of attorneys to fight again for what we just voted in. It seems that Americans have always voted, then lived with whatever the vote turned out to be. We have not witnessed any demonstrations over the fact that certain people were voted in at the national or local level. But those who are sympathetic with the sexual liberty community have determined the minority will override the majority.
The California Supreme Court started this battle. They determined last April that they would rule against 67% of California citizens who voted for Prop 22. That ruled that marriage would remain to be between a man and a woman. However, 7 judges voted to over rule millions of California citizens. This case will now be determined not only regarding the vote of the people, but by the fact that it is an Amendment and weather citizens can vote for such an amendment. Does this violate the separation of powers doctrine to ensure equal protection of the law.
The next part of this battle is legal. The California Supreme Court will hear this case and as determined by them in the next few weeks. We should have a legal opinion by this summer.
